Collection Agencies – How They Operate and Who to Avoid

The job of the collection agencies is to collect debts owed by individuals and businesses.  The agencies basically operate as the agents of the creditors and charge some fee or percentage of the total amount owed.

But the collection agencies hold a very bad reputation of threatening and harassing people for collecting debts. Therefore, in many countries there are stringent laws to forbid the abusive practices. In case the agencies fail to abide by the law then it can lead to lawsuit or government regulatory action. There are different types of agencies like the first party agency or the third party agency.

Sometimes the collection agencies are the subsidiaries of the companies, which own the original debt. The first party agencies have the primary right to get involved in the debt collection process. These agencies are actually the first party to the contract that is the creditors.

The collection agencies are actually the third party agencies. Here the agencies can make money only if money is collected from the debtor. The collection agencies actually collect a percentage of the fee collected from the debtor. In the U.S., the third party agencies are subject to the Fair Debt Collection Practices Act of 1977. The Federal Trade Commission actually administers this federal law.

How the Agencies Operate?

Suppose you owe some money to any creditor but have not made your payments in time, then the creditor can turn your account to the collection agencies. In many countries, it is the rule that the collection agencies must inform you in writing that an account in your name has been turned over to them. However, always remember to collect a receipt once you have paid the money to the creditor and try to avoid paying in cash. It always better to unburden your shoulder by paying off the debts as soon as possible.

In case of the creditors it is advisable to collect detailed information about collection agencies before hiring them because any action taken by them can have direct impact on you and your company. Therefore if you find it very difficult to collect money from your debtor then it is advisable to seek the help of authentic and dutiful collection agencies.
