Default Amazon sues New York State :Challenging New Tax Law and Affect on Internet

Now this is something i think we all need to keep a eye on and see how this develops and how this might effect everything we use on the Internet

Earlier this month, Amazon.com sued New York State over a new tax law that forces out-of-state Internet retailers with no physical presence in New York to collect sales and use taxes. The law, which Amazon argues is unconstitutional, states that an online retailer "shall be presumed to be soliciting business...if the seller enters into an agreement with a resident of this state under which the resident refers potential customers, whether by a link on an Internet website or otherwise, to the seller, if the cumulative gross receipts from sales by the seller to customers in this state who are referred to the seller…is in excess of $10,000 [per year]." When all is said and done, this language may have have some impact on the very structure of the affiliate marketing industry.



I am sure that there may be major problems on trying to determine hat online retailers are in what state and if there are many affiliates
